Wireless & SMS Policy

1. Introduction
This Wireless & SMS Policy (“Policy”) governs the use of text messaging, Short Message Service (“SMS”), Multimedia Messaging Service (“MMS”), and other wireless communications (collectively, “Messaging Services”) provided by bosom’d LLC (“bosom’d,” “we,” “us,” or “our”).
This Policy applies to all Messaging Services offered through bosom’d’s websites, customer support channels, promotional programs, and related services (collectively, the “Services”) and should be read together with bosom’d’s Privacy Policy and Terms and Conditions.
This Policy applies solely to wireless and text-based communications and does not govern email, live chat, or phone communications, which are governed by bosom’d’s Terms and Conditions.
2. Scope of Messaging Services
bosom’d Messaging Services may include system or transactional messages (such as account verification, security alerts, order confirmations, and shipping notifications), customer service communications, account notifications, policy updates, and marketing or promotional messages where permitted by law and consent has been provided.
Note: bosom’d does not provide emergency, medical, or safety alerts through Messaging Services. Messaging Services are not intended for urgent or emergency use.
3. Consent and Authorization
By providing your mobile phone number and affirmatively opting in, you expressly consent to receive automated and non-automated Messaging Services from bosom’d.
- Consent: Consent is not a condition of purchase and may be revoked at any time.
- Representation: You represent that you are the authorized subscriber or customary user of the phone number provided and that you are at least 18 years of age or have parental or legal guardian consent.
- Accuracy: You are responsible for providing and maintaining an accurate and current mobile phone number.
4. Message Frequency and Delivery
Message frequency varies based on user interaction and service activity.
- No Guarantee: bosom’d does not guarantee delivery timing, order, or uninterrupted availability of Messaging Services. Messages may be delayed, blocked, or fail due to carrier limitations, network conditions, spam filtering, or device settings beyond bosom’d’s control.
- Reliability: Messaging Services should not be relied upon for time-sensitive or critical communications.
5. Informational Nature of SMS Communications
If you initiate contact with bosom’d via SMS or request SMS communication for customer support or related inquiries, you consent to receive SMS or MMS messages related to that inquiry.
Messages sent via SMS or MMS may include system or transactional messages, customer service responses, sizing guidance, promotional content, or other informational communications. All such messages are provided for general informational and customer support purposes only and do not constitute guarantees, warranties, professional advice, or binding commitments.
Policy Precedence:
- Any information, guidance, or recommendations provided via SMS are subject to and governed by bosom’d’s Terms and Conditions and all applicable policies referenced therein (including the Privacy Policy, Cookie Policy, Returns & Refunds Policy, and Limited Warranty Policy).
- SMS communications do not modify, supersede, or amend bosom’d’s written policies. Customers should rely solely on bosom’d’s official policies, product documentation, and written terms when making purchasing, sizing, or product-related decisions.
- Sizing Disclaimer: Customers acknowledge that automated or human-assisted SMS responses may be based on limited information and should not be relied upon as definitive determinations regarding sizing, fit, comfort, performance, or product suitability.
6. Carrier Charges and Responsibility
bosom’d does not charge for Messaging Services. Standard message and data rates imposed by your wireless carrier may apply.
- Liability: You are solely responsible for all carrier fees. Wireless carriers are not liable for delayed, undelivered, or misdirected messages.
7. Opt-Out and Help
- Opt-Out: You may opt out at any time by replying “STOP”. After opting out, you will no longer receive messages unless you re-enroll.
- Help: For assistance, reply “HELP” or contact us at https://bosomd.com/customer-care/.
8. Reassigned Numbers
You are responsible for maintaining accurate and current contact information.
- Reassigned Numbers: bosom’d is not responsible for messages sent to reassigned, recycled, or incorrect phone numbers, including numbers reassigned by wireless carriers.
- Notification: If you believe you are receiving messages in error or that your phone number has been incorrectly associated with an account, you should reply “STOP” and contact our Customer Care Team promptly.
9. Third-Party Providers
bosom’d may use third-party vendors and service providers to support Messaging Services. These providers act solely on bosom’d’s behalf and are contractually restricted from using your information for independent purposes. While bosom’d works with reputable providers, it does not control wireless carrier networks or third-party platforms and is not responsible for delays, delivery failures, or interruptions resulting from systems or services outside its reasonable control.
10. Data Use and Privacy
Information collected through Messaging Services is handled in accordance with bosom’d’s Privacy Policy. bosom’d does not sell phone numbers or share SMS data for third-party marketing.
11. Security and Unauthorized Use
bosom’d takes reasonable measures to protect the integrity and security of its SMS and wireless communications systems. However, no method of electronic communication is completely secure, and bosom’d cannot guarantee that SMS or MMS messages will be free from interception, unauthorized access, delay, alteration, or disruption.
11.1 User Responsibility
You acknowledge and agree that you are responsible for maintaining the security of your mobile device, wireless account, phone number, and any credentials or access controls associated with your account, including safeguarding against unauthorized use, loss, theft, or compromise of your device or phone number.
11.2 Liability Disclaimer
bosom’d shall not be responsible or liable for unauthorized access to or use of SMS communications, including but not limited to access resulting from:
- Loss or theft of your mobile device;
- SIM swapping, number porting, or reassignment by your carrier;
- Credential compromise, phishing, malware, or social engineering;
- Access by third parties with physical or electronic access to your device; or
- Actions or omissions of wireless carriers or third-party service providers.
11.3 Reporting and Risk
You agree to promptly notify bosom’d if you believe your mobile device, phone number, or SMS communications have been compromised or used without authorization. To the maximum extent permitted by applicable law, bosom’d disclaims liability for any loss, damage, or harm arising from unauthorized or fraudulent use of SMS communications.
- Warning: SMS messages may be accessible to anyone with access to your mobile device or messaging inbox and should not be used to transmit sensitive personal or financial information.
12. Modification or Termination
bosom’d may modify, suspend, or terminate Messaging Services at any time for operational, security, compliance, or business reasons, with or without notice, subject to applicable law.
13. Limitation of Liability
To the maximum extent permitted by applicable law, bosom’d shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or related to Messaging Services, including delays, non-delivery, or reliance on message content.
14. Indemnification
Your use of Messaging Services is subject to the indemnification obligations set forth in bosom’d’s Terms and Conditions.
Specific SMS Indemnification: Without limiting the scope of the Terms and Conditions, you specifically agree to indemnify, defend, and hold harmless bosom’d LLC from any claims, damages, losses, or expenses (including attorneys’ fees) arising out of or related to:
- Your provision of a mobile phone number that is not your own or that you are not authorized to use;
- Your failure to notify bosom’d of a change in your mobile phone number; or
- Your violation of this Policy or applicable law.
15. Governing Terms
Messaging Services are governed by bosom’d’s Terms and Conditions, including arbitration and limitation-of-liability provisions.
16. International Use
Messaging Services are intended for use within the United States and may not comply with laws or regulations outside the United States. Use of Messaging Services outside the United States is at your own risk.
17. Policy Updates
bosom’d may update this Policy from time to time to reflect changes in our practices, technologies, legal requirements, or other operational needs.
- Notice: When we do, we will revise the “Last Updated” date at the top of this Policy. Unless otherwise required by applicable law, posting an updated Wireless & SMS Policy constitutes notice, and the updated Policy will be effective as of the date posted.
- Acknowledgment: Your continued use of the Services after the effective date of an updated Wireless & SMS Policy indicates your acknowledgment of the updated Policy, to the extent permitted by law.
