Limited Warranty Policy

Effective Date: January 13, 2026

 

1. Scope and Introduction

This Garment Limited Warranty (“Warranty”) applies solely to bosom’d-branded Garments, including bras and other apparel products (“Garments”) purchased directly from bosom’d by the original purchaser for personal use.

This Warranty applies only to purchases made within the United States and is enforceable solely under U.S. law. This Policy operates in conjunction with bosom’d’s Terms and Conditions and Returns & Refunds Policy.

Non-Applicability: This Warranty does not apply to non-Garment items, including wash bags, measuring tools (including the bd Sizing Sidekick®), accessories, promotional items, packaging, or complimentary products.

 

2. Eligibility and Transferability

This Limited Warranty applies only to the original purchaser of the Garment and is generally non-transferable.

2.1 Permitted Transfers

The Warranty may be exercised by an individual other than the original purchaser only in the following limited circumstances, provided valid proof of original purchase is supplied:

  • Household Purchase: The Garment was purchased by the original purchaser for use by another individual residing in the same household (requires original purchaser’s name and order number).
  • Gifted Garments: The Garment was gifted by the original purchaser to another individual (requires the original purchaser’s name and order number). bosom’d reserves the right to request verification to confirm the gift.

 

2.2 Voided Eligibility

This Warranty does not apply to Garments that have been:

  • Resold, exchanged for value, or transferred for consideration.
  • Donated, consigned, or sold through secondary marketplaces (e.g., thrift stores, Facebook Marketplace, etc.).
  • Obtained from unauthorized sellers or third parties.
  • Distributed through giveaways, contests, promotional programs, or influencer seeding (unless expressly approved in writing).

 

3. Limited Warranty Coverage (Manufacturing Defects)

bosom’d warrants that new bosom’d-branded Garments will be free from manufacturing or material defects (“Defects”) for a period of sixty (60) days from the original purchase date (“Warranty Period”).

3.1 What is Covered

This Warranty covers Defects that arise during normal wear within the Warranty Period, provided the Garment has been used and maintained in strict accordance with bosom’d’s care instructions.

Examples of Covered Defects (Non-Exhaustive):

  • Broken, protruding, or improperly seated underwire caused by manufacturing failure.
  • Stitching, seam separation, or fabric failure attributable to defective materials.
  • Strap, hardware, or material detachment resulting from manufacturing defects.
  • Closure, hook, eye, or fastener failure caused by defective construction.

3.2 What is NOT Covered (Fit vs. Defect)

This Warranty does not cover dissatisfaction related to fit, comfort, appearance, level of support, sizing preference, or subjective wear experience.

  • Fit Issues: Such concerns are governed exclusively by the 30-Day Happiness Guarantee as described in the Returns and Refunds Policy.
  • Data Accuracy: Issues arising from incorrect “My Perfect Fit” measurements, customer-provided data, incorrect use of the bd Sizing Sidekick®, or reliance on algorithmic sizing recommendations do not constitute Defects and are not covered.

 

4. Exclusions and Care Requirements

This Warranty is void if damage results from improper care, alteration, misuse, laundering errors, normal aging, or modification of any component (including the tagless tag).

4.1 Care Instructions

Care instructions are provided on Garment labels, packaging, wash bags, and/or the bosom’d website.

4.2 Mandatory Laundering Practices

Failure to wash delicate Garments—including bras, lace-trimmed items, mesh fabrics, or items with hardware/underwire—using a bd wash bag (or a comparable mesh bag of similar size and construction) may result in damage.

  • Consequence: Warranty claims typically will be denied if damage is reasonably attributable to improper laundering or failure to use a protective wash bag where recommended.

 

5. Fit, Measurement, and Sizing Disclaimer

bosom’d offers proprietary sizing tools (including the bd Sizing Sidekick® and “My Perfect Fit” process) to assist customers. However:

  • Customer Responsibility: Customers are solely responsible for using tools correctly and providing truthful measurements. bosom’d does not independently verify customer measurements and data.
  • Guidance Only: Sizing recommendations are guidance only and do not guarantee fit, comfort, or performance.
  • Exclusions: Warranty coverage does not apply to issues arising from inaccurate measurements, body changes over time, or subjective fit preferences.
  • Technology Requirement: Site cookies and similar technologies are required to support session continuity and accurate sizing calculations. Disabling cookies prevents the system from adequately providing the appropriate assistance; therefore, disabling cookies may void warranty coverage related to sizing outcomes.

 

6. Remedies

If a Defect is confirmed by bosom’d, the exclusive remedies are:

  1. Repair or Replace: bosom’d will repair or replace defective Garments at its sole discretion.
  2. Refund: In limited circumstances, bosom’d may elect to issue a merchandise (store) credit or refund as an alternative remedy. Credits and Refunds are not guaranteed.

Note: Replacements or repaired items do not restart or extend the original Warranty Period.

 

7. Disclaimer and Limitation of Liability

To the maximum extent permitted by applicable law, this Warranty is the sole and exclusive warranty applicable to bosom’d Garments and replaces all other express or implied warranties, including implied warranties of merchantability or fitness for a particular purpose.

  • Damages: bosom’d shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from the use or inability to use any Garment, including claims for discomfort or allergic reaction.
  • Exceptions: Nothing in this Warranty excludes liability for bodily injury or death to the extent such liability cannot be excluded under applicable law.

 

8. Governing Law

  • Governing Law: This Warranty is governed by the laws of the State of Colorado.
  • Dispute Resolution: Any dispute arising from this Warranty shall be resolved through binding arbitration in accordance with bosom’d’s Terms and Conditions.

 

9. Policy Updates

bosom’d reserves the right to update or modify this Warranty from time to time. Any updates will be effective when posted on bosom’d’s website with a revised effective date. The version of the Warranty in effect at the time of the original purchase will govern that purchase.
