1. General Sales Tax Information
bosom’d is required by law to collect applicable sales or use tax on orders based on the “ship to” address.
- Jurisdiction: Sales tax is calculated and charged in accordance with the laws of the state, county, and municipality where the order is being delivered.
- Tax on Shipping: Please be aware that some states require sales tax to be assessed on shipping, handling, and processing charges. If your delivery state requires it, tax will be applied to these charges as well.
- Transparency: All applicable taxes will be clearly displayed as a separate line item on your final order checkout screen and receipt.
2. Specific State Disclosures
As a Colorado-based business, bosom’d is required to comply with specific state and local tax laws for orders shipped to Colorado addresses.
2.1 Colorado Customers
As a Colorado-based business, bosom’d is required to comply with specific state and local tax laws for orders shipped to Colorado addresses.
- State & Local Tax: Orders are assessed Colorado state sales tax plus applicable city, county, and special district taxes based on the delivery address.
- Retail Delivery Fee: In accordance with Colorado law, a state-mandated Retail Delivery Fee is applied to all retail deliveries made by motor vehicle to a location in Colorado. This fee is separate from shipping costs and is non-refundable.
2.2 Minnesota Customers (Retail Delivery Fee)
Effective July 1, 2024, the State of Minnesota imposed a Retail Delivery Fee on retail transactions that equal or exceed $100.
- Requirement: If your order total meets this threshold, this state-mandated fee will appear as a separate line item on your receipt (often labeled as “Road Improvement and Food Delivery Fee”).
- Purpose: This fee is collected by bosom’d and remitted directly to the Minnesota Department of Revenue as required by law.
3. Tax-Exempt States
For your convenience, we currently do not collect sales tax on orders shipped to the following states, as they generally do not impose a statewide sales tax:
- Alaska (Note: Some local municipalities in Alaska may still levy a local tax, which will be collected if applicable).
- Delaware
- Montana
- New Hampshire
- Oregon
4. Rates and Policy Changes
State sales tax rates, fee structures, and tax laws are subject to change at any time by legislative or regulatory action. bosom’d systems are updated regularly to reflect current tax rates and requirements.
5. Errors, Exemptions, and Refunds
Sales and use tax is charged based on the taxing jurisdictions of the shipping destination and applicable exemptions.
- Refund Requests: While bosom’d strives to ensure that all applicable taxes are charged correctly, if you believe you were charged sales or use tax in error, please contact our Customer Care Team to file for a potential refund.
